1. Purpose and acceptance

These Terms of Service ("Terms") govern access to and use of the TopbisGo mobile application (the "Application", the "Service"). By creating an account or using the Application, you accept these Terms together with our [Privacy Policy]. If you do not accept these terms, do not use the Service.

The version of the Terms in force is identified by a version number displayed at the top of the page in the Application. Your acceptance is collected when you create your account.

3. Description of the Service

TopbisGo is a mobile marketplace that connects private sellers and buyers in Cameroon. The Service allows you to:

TopbisGo includes no payment facility. No order, no payment collection and no delivery passes through the Application. Negotiation, payment and handover of the item take place directly between buyer and seller, outside the Application and under their sole responsibility.

4. Role of TopbisGo

TopbisGo is a mere technical intermediary that connects users. We are not a party to the transactions concluded between users. We do not own, verify, store or deliver any of the items offered, and we guarantee neither their existence, nor their quality, nor their legality, nor the accuracy of the listings, nor the sellers' ability to sell or the buyers' ability to pay.

We recommend the usual precautions: examine the item before paying, prefer in-person handovers in public places, and never pay a deposit to a stranger.

5. Accounts and eligibility

5.1 Age. The Service is reserved for persons aged at least 18. By creating an account, you declare that you have reached that age.

5.2 Guest mode. You may browse the catalog without an account. Member actions (favorites, messaging, posting, reporting, blocking) require a full account.

5.3 Account creation. An account is created with an e-mail address or a phone number and a password, or via Google or Apple. You undertake to provide accurate information and to keep your credentials confidential. You are responsible for any activity carried out from your account.

5.4 Seller phone number. Before your first listing is published, you are asked for a Cameroonian mobile number. This number is never shown to other users; contact between users happens only through the built-in messaging.

5.5 Agent code. When signing up, you may enter the code of a TopbisGo field enrollment agent. This code is used solely to attribute your sign-up to that agent as part of our field campaigns.

6. A service between private individuals (C2C)

The Service is, at this stage, reserved for private sellers acting outside any commercial, industrial, artisanal or professional activity. Using the Service for professional selling, or for habitual selling of a commercial nature, is prohibited and may lead to the removal of the listings concerned or the suspension of the account.

7. Listings

7.1 Posting rules. Every listing must describe a real item that you are entitled to sell, with faithful photos of the item itself and a price in FCFA. A listing is attached to a quartier, never to a precise address.

7.2 Prior moderation. Published listings are subject to review (automated and, where applicable, human) before or after they go live. A listing may be put on hold, rejected with a reason, or removed at any time if it breaches these Terms. The publication of a listing does not constitute approval of its content by TopbisGo. The remedies against a moderation decision are described in article 10.

9. Messaging, reporting and blocking

9.1 Messaging. The built-in messaging is reserved for communication relating to listings. Messages are private between the participants in the conversation.

9.2 In-app reporting. You may report a listing, a user or a message. Reports are rate-limited and reviewed by our team. Reported content, including messages, may be reviewed by authorized TopbisGo moderators to investigate abuse and enforce platform rules.

9.3 Blocking. You may block a user at any time: they will no longer be able to write to you and you will stop receiving notifications about them. Unblocking is possible at any time from the settings.

10. Notification of illegal content and remedies

10.1 Notification (notice and takedown). Any person (whether a user or not, including a holder of intellectual property rights or an authority) may notify us of content they consider illegal by writing to info@topbisgo.com, specifying:

We acknowledge receipt and process complete notifications as promptly as possible. Where the illegality is manifest or a competent authority so orders, the content is removed or made inaccessible promptly.

10.2 Information of the author and counter-notification. Unless legally prohibited, the author of removed content is informed of the removal and its reason, and may submit observations in response (counter-notification) to the same address.

10.3 Remedies against moderation decisions. Any decision rejecting a listing, removing content, suspending or banning an account may be contested by writing to info@topbisgo.com within 30 days, indicating the account concerned and the grounds for the contestation. We re-examine the decision and respond within a reasonable period not exceeding 15 business days. This internal remedy does not deprive the user of the right to bring the matter before the competent courts.

10.4 Abusive notifications. Knowingly inaccurate or abusive notifications may engage the liability of their author.

11. Suspension and banning

In the event of a breach of these Terms, TopbisGo may, depending on severity: remove content, put a listing on hold, temporarily suspend an account, or permanently ban an account. A ban takes effect immediately: live listings are withdrawn and write access is blocked. Measures taken by the moderation team are recorded in an internal audit log and may be contested under the conditions of article 10.3.

12. Intellectual property

12.1 Your content. You remain the owner of the content you publish (listings, photos, avatar). By publishing it, you grant TopbisGo a worldwide, non-exclusive, royalty-free licence to host, reproduce, display and technically adapt (resizing, compression) that content, solely for the purpose of operating the Service. This licence ends when the content or the account is deleted, subject to the retained records described in the Privacy Policy.

12.2 Our elements. The Application, the TopbisGo brand, the logos, texts and graphic elements of the Service are protected. Any unauthorized reproduction is prohibited.

12.3 Rights infringements. Rights holders may notify an infringement under the conditions of article 10.1.

13. Personal data

The processing of your personal data is described in our [Privacy Policy], which forms an integral part of these Terms. The Application notably allows you to export your data and delete your account directly from the settings.

14. Availability of the Service

The Application is designed to work even with an intermittent connection: certain actions performed offline are synchronized as soon as the network returns. The Service is provided "as is"; we do not guarantee uninterrupted availability and may change, suspend or discontinue all or part of the Service, with reasonable notice where possible.

15. Liability

15.1 Transactions between users. As TopbisGo is not a party to the transactions, we are not liable for disputes between users (failure to pay, non-conforming item, no-show at a meeting, or any other dispute arising from the transaction).

15.2 User content. Subject to our legal obligations to remove notified illegal content (article 10), we are not liable for content published by users.

15.3 Limitations. To the extent permitted by law, we are not liable for indirect damages, loss of profit or loss of data connected with the use of the Service, nor for interruptions due to causes beyond our reasonable control.

15.4 Exceptions — what we never exclude. Nothing in these Terms excludes or limits our liability in the event of:

16.1 By you. You may delete your account at any time from "Privacy & data" in the Application. The effects of deletion are described in the Privacy Policy.

16.2 By us. We may suspend or terminate your access under the conditions of article 11, or where the law requires it.

17. Access to, retention and modification of the Terms

17.1 Permanent access and durable copy. The Terms in force can be consulted at any time in the Application ("You" → "Terms of Service"). You may at any time obtain, free of charge, a copy on a durable medium (PDF or text file) upon simple request to info@topbisgo.com.

17.2 Versions. Each published version of the Terms bears a version number, displayed at the top of the page. Earlier versions are archived and can be provided on request.

17.3 Modifications. We may modify these Terms. In the event of a substantial modification (affecting your essential rights or obligations), we will inform you before it enters into force by an appropriate means (in-app notification or e-mail) and, where the law requires it, we will collect your acceptance again. Minor modifications (corrections, clarifications) enter into force upon publication. If you refuse a new version, you may stop using the Service and delete your account.

18. Governing law and disputes

These Terms are governed by Cameroonian law. Any dispute relating to their interpretation or performance shall, failing amicable resolution, be submitted to the competent courts of Yaoundé, subject to mandatory jurisdiction rules, in particular those protecting consumers.
